Why don’t people take an LPA ?

1 Lack of Awareness

Many people simply don’t know what an LPA is or assume it’s only needed in very old age or when diagnosed with an illness like dementia.

Some believe their spouse or children can automatically make decisions for them — which isn’t true without legal authority.

2 Denial or Avoidance

Planning for loss of mental capacity is uncomfortable.

People often avoid it because it feels like “tempting fate” or admitting vulnerability.

3 Complexity and Cost

The process can seem confusing or too legalistic.

While DIY online forms are available, many prefer legal help, which can cost hundreds of pounds.

There’s also a registration fee (£82 per LPA in England and Wales), which some may see as a barrier.

4 Misunderstanding Timing

Many think LPAs are only needed in old age, not realising accidents, strokes, or illness can happen at any time.

◦ By the time an LPA is truly needed, it might be too late to set one up if the person lacks mental capacity.

5 No Immediate Benefit

LPAs don’t offer a “now” benefit — they’re a contingency tool.

◦ This makes them less of a priority compared to wills, pensions, or home ownership.

An LPA is only a priority when you need it and by then it will be too late if you do not have one
